The operator of bbwpictures.com is not the primary "producer" of any depictions of explicit sexual or simulated sexual activity that may be offered there. The operator of said website only undertakes the activities of transmission, storage, retrieval, hosting, or formatting of content, which may depict explicit sexual activities, that appears on the website as the result of actions taken by third-party users. All parts of bbwpictures.com on which user-furnished content appears are under said users’ control. Owing to this, the operators and owners of the website are exempt from compliance with Section 2257 records keeping and labeling obligations as stipulated in 28 C.F.R. §75.1(c)(4). Any content that is believed to be illegal, obscene, harmful, harassing, defamatory or in any manner incompatible with the terms of use and policies of the website, may be removed at the operator’s or owner's sole discretion, pursuant to 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. § 230(c).
Any visual depictions that may appear on the website, for which the operator of the website may be held to be the “producer,” are not subject to the stipulations of 18 U.S.C. § 2257 and 28 C.F.R. Part 75 for one or more of the following reasons: (1) the images or videos do not display any sexually explicit activity as outlined in 18 U.S.C. § 2256(2)(A); (2) the images or videos do not display depictions of the genitals or pubic area after July 27, 2006; (3) the images or videos do not display simulated sexually explicit conduct; or (4) the images or videos were created before July 3, 1995.
